Judicial Review

The Encyclopedia defines judicial review as “the power of a court to review a law or an official act of a government employee or agent for constitutionality or for the violation of basic principles of justice” (Wikipedia 1). Therefore, judicial review is the power of the courts to declare laws of Congress, laws of states, and actions of the president, government employee or agent unconstitutional and invalid when they conflict with the U.S. Constitution. The general label “judicial review” applies to the procedures when a court is asked to determine the legality of a governmental action. The goal of judicial review is to ensure that governmental officials stay within their legal authority, follow prescribed procedures, and have a factual basis for their decisions when that is legally required.
