Compulsory Licensing and Parallel Imports;
Democratizing Access to Essential Medicines in Sub-Saharan African Countries
Abstract
Specifically the ideas of compulsory licensing and parallel imports are key ways to promote access to essential medicines, a poignant and particular example being in Sub-Saharan African countries. That these practices are not only legal and within established GATT and WTO rules, but are embraced in industrialized countries to apply to other products. U.S. foreign policy needs to embrace these ideas in their aggressive pressure placed on certain African countries implementing them, and join the fight on the side of public well-being and not the pharmaceutical industry.
