Global Patent Law

ABSTRACT

For many years the European Union (“EUâ€) has struggled to find a balance between uniformity of laws and the limitation of EU power to the economic sphere. This struggle is exemplified in the quest for a standardized set of patent laws and a uniform system of application and enforcement. In recent years, several solutions have been proposed and largely abandoned, including the European Community Patent system. What remains of the individual national patent systems offers little to ensure the intellectual property rights of the citizens of the globe are effectively and efficiently protected. As a result, inventors remain without the protection of a cohesive system for securing their patent rights. In cases where patent rights are violated, enforcing a rightful claim to an invention can become an arduous, expensive and time-consuming effort.
