Indiana Victim's Rights
Victim’s rights in the state of Indiana can be found in the Indiana Code (IC 35-40-5). There are nine distinct areas pertaining to a victim’s rights. The first is the “right to fairness, dignity and respect” (IC 35-40-5-1). This simply states that the victim has these rights throughout the entire criminal justice process. Second is the “release or escape from custody of perpetrator” (IC 35-40-5-2). This states that the victim has the right to be informed upon request if the person or persons accused or convicted of committing a crime against them has escaped from the custody of either a public or private institution in which they have been held. The third is the “right to confer with the prosecuting attorney’s office” (IC 35-40-5-3). This states that, under certain circumstances, the victim can speak with the prosecuting attorney’s office about the crime or court proceedings.
